Punjab MLA defections have brought party switching and the Tenth Schedule into focus before the state’s next Assembly election. The episode also offers a practical case for studying Indian polity and legislative accountability.
Quick answer: In the Punjab MLA defections, three Aam Aadmi Party legislators joined the Bharatiya Janata Party in New Delhi on 2 November 2026. Two had quit party membership on 1 November, while Kunwar Vijay Pratap Singh resigned as an MLA on 2 November. The episode raises questions about legislative resignation and anti-defection rules.
What happened in Punjab?
Three Aam Aadmi Party (AAP) Members of the Legislative Assembly (MLAs) joined the Bharatiya Janata Party (BJP) on 2 November. The move took place at the BJP headquarters in New Delhi, ahead of the Punjab Assembly election due in 2027.
On 1 November, Chetan Singh Jauramajra and Harmeet Singh Pathanmajra quit AAP’s primary membership. They cited the party’s failure to fulfil promises made during the 2022 Assembly polls. Meanwhile, AAP spokesperson Kuldeep Singh Dhaliwal criticised the BJP for inducting leaders from other parties.
| Legislator | Source details |
|---|---|
| Kunwar Vijay Pratap Singh | Former Indian Police Service officer; recently suspended from AAP; resigned as MLA on 2 November. |
| Harmeet Singh Pathanmajra | Represents Sanour in Patiala district; quit AAP membership on 1 November. |
| Chetan Singh Jauramajra | Former minister and Samana MLA; quit AAP membership on 1 November. |
The source records Singh’s resignation as an MLA, but does not establish its acceptance. It also does not establish the Assembly-seat status of the other two legislators after their party resignations.
What does the anti-defection law provide?
The Tenth Schedule sets grounds for disqualifying legislators who change party allegiance or defy specified party directions. The Constitution’s 52nd Amendment added it in 1985 to address political defections.
An elected member can face disqualification for voluntarily giving up membership of the party on whose ticket the member was elected. Moreover, conduct may establish voluntary abandonment even without a formal resignation from the party.
Disqualification can also arise when a member votes or abstains contrary to a party direction, without prior permission. However, the Schedule provides an exception if the party condones that action within 15 days.
The Speaker decides disqualification questions in a state Assembly. The Supreme Court’s decision in Kihoto Hollohan recognised judicial review of such decisions. Thus, joining another party and a final legal finding of disqualification are distinct events.
Which constitutional provisions matter?
The Tenth Schedule and Article 190 govern different aspects of party switching and Assembly membership.
| Provision | What it provides |
|---|---|
| Article 191(2) | A state legislator is disqualified if the Tenth Schedule so provides. |
| Tenth Schedule, paragraph 2 | Sets disqualification grounds, including voluntary departure and specified voting contrary to party directions. |
| Tenth Schedule, paragraph 4 | Provides a merger exception subject to its conditions, including agreement by at least two-thirds of the legislature party. |
| Article 190(3)(b) | A seat becomes vacant upon resignation accepted by the Speaker, who must reject it if not voluntary or genuine. |
| Article 164(1B) | Restricts ministerial appointment of a member disqualified under the Tenth Schedule for the specified period. |
The 91st Amendment removed the earlier exception for a split involving one-third of a legislature party. Therefore, three legislators joining another party does not by itself establish a qualifying merger.
Why do resignation and disqualification differ?
Party resignation concerns political membership, while Assembly resignation concerns the legislative seat. Consequently, quitting a party does not itself amount to an accepted resignation from the House.
Under Article 190, the Speaker examines whether a seat resignation is voluntary and genuine. Separately, the Tenth Schedule addresses whether a member has incurred disqualification. The Punjab MLA defections therefore require attention to each legislator’s actions and procedural status, rather than a presumption that all three face identical outcomes.
Disqualification under the Schedule carries consequences beyond losing the seat. Article 164(1B), for example, restricts ministerial appointment until the term expires or the person is re-elected, whichever is earlier. A resignation from the House and a disqualification order should not be treated as interchangeable.
What are the governance concerns and reform options?
Punjab MLA defections illustrate the tension between party stability, representative autonomy and accountability to voters.
- Legislative stability: Party switching can alter political alignments; therefore, anti-defection rules seek to discourage opportunistic departures.
- Individual judgement: Broad party directions can also constrain debate and an MLA’s ability to differ on legislation.
- Impartial adjudication: The Speaker’s political background can raise concerns about neutrality; moreover, delayed decisions may weaken the law’s practical effect.
- Voter accountability: A change of party can challenge expectations formed at election time, although voters may assess each move differently.
A reform debate can consider a clear decision timeline, an independent adjudicatory mechanism and a narrower scope for party directions. However, each proposal requires careful design: a strict deadline supports certainty, while fair procedures must still allow both sides to present their case.
Similarly, limiting party directions could improve deliberation but may reduce discipline on issues central to government stability. The objective is to balance a representative’s voice with credible rules against opportunistic switching.

- UPSC CSE Mains 2026 (GS Paper II): Examine whether the Lok Sabha Speaker’s office has become vulnerable to partisan politics under the anti-defection regime. What institutional changes would ensure neutrality in a polarised House?
- UPSC CSE Prelims 2022 (GS Paper I): Does anti-defection law bar a nominated legislator from joining a party within six months, and does it specify a deadline for the presiding officer’s decision?
UPSC tests both the Schedule’s detailed rules and the institutional implications of the Speaker’s role.
Punjab PCS candidates should connect the named legislators and constituencies to state legislative procedures. Similarly, Haryana HCS preparation should cover the Speaker’s role, Assembly resignations and the Tenth Schedule.

Frequently Asked Questions
Which Punjab AAP MLAs joined the BJP?
Kunwar Vijay Pratap Singh, Harmeet Singh Pathanmajra and Chetan Singh Jauramajra joined the BJP. They did so in New Delhi on 2 November 2026.
Does quitting a party automatically mean resigning from the Assembly?
No, since party membership and an Assembly seat are distinct. Article 190 separately governs acceptance of a legislator’s seat resignation.
Who decides anti-defection cases in a state Assembly?
The Speaker decides such disqualification questions under the Tenth Schedule. However, the decision is subject to judicial review.
Is a group of three MLAs automatically exempt from disqualification?
No, because the number alone does not establish the merger exception. The Tenth Schedule requires its merger conditions to be satisfied, including the two-thirds threshold.
