Third party insurance

UPSC Relevance

This topic is important for GS Paper II (Governance and Judiciary) and GS Paper III (Technology and Road Safety), covering judicial activism, digital governance, insurance regulation and citizen welfare.

Institution Supreme Court of India.
Objective Improve insurance coverage and protect accident victims.
UPSC Themes Road safety, governance, digital technology and insurance regulation.

What is Third Party Insurance?

Third-party insurance is a compulsory motor insurance policy that compensates another person for injury, death or property damage caused by the insured vehicle in an accident. It does not cover damage to the owner’s own vehicle.

Why is it Called ‘Third Party’?

  • First Party: Vehicle owner.
  • Second Party: Insurance company.
  • Third Party: Accident victim who receives compensation from the insurer.

Types of Motor Insurance

  • Third-Party Insurance: Mandatory under law and covers damage or injury caused to others.
  • Comprehensive Insurance: Optional but recommended; covers third-party liability as well as damage to the insured vehicle from theft, fire, natural disasters and similar risks.

Motor Vehicles Act, 1988

The Motor Vehicles Act, 1988 governs vehicle registration, licensing, road safety standards, compulsory motor insurance, compensation for accident victims, traffic offences and transport permits. Third-party insurance is compulsory for all motor vehicles used in public places.

What is the Proposed Pilot Project?

The suggested pilot project would involve:

  1. A vehicle arriving at a fuel station.
  2. Automatic Number Plate Recognition (ANPR) capturing the registration number.
  3. The system verifying whether valid third-party insurance exists.
  4. If no valid insurance is found, fuel may be denied.

This is a judicial suggestion for a pilot project and not an existing nationwide policy.

What is ANPR?

Automatic Number Plate Recognition (ANPR) is an AI-enabled technology that captures vehicle registration numbers, converts them into digital text using optical character recognition and matches them with official databases. The technology is already used for traffic enforcement, toll collection, stolen vehicle detection, parking management and insurance verification.

Role of IRDAI

The Insurance Regulatory and Development Authority of India (IRDAI) is the insurance regulator responsible for regulating the sector, protecting policyholders, promoting insurance penetration and ensuring fair market practices.

Why Link Fuel Purchase with Insurance?

  • Every vehicle requires periodic refuelling.
  • Fuel purchase becomes a powerful compliance checkpoint.
  • It encourages timely insurance renewal.
  • It improves overall compliance with mandatory insurance requirements.

Potential Benefits

  • Road Safety: Better protection for accident victims.
  • Economy: Stronger insurance penetration.
  • Citizens: Faster and fairer compensation.
  • Technology: Improved digital governance and transparency.

Concerns and Challenges

  • Social: Impact on vehicle owners and drivers.
  • Technical: Database integration and system accuracy.
  • Governance: Data privacy and digital security.
  • Administrative: Implementation and operational complexity.

International Practices and Way Forward

Several countries use automated insurance verification, electronic enforcement systems, registration-linked insurance databases and strict penalties for non-compliance. For India, it is suggested to integrate VAHAN and insurance databases, send renewal reminders, strengthen public awareness, ensure cybersecurity and test the proposal through pilot projects before wider implementation.
