Bureaucratic control lies with Delhi government

  • Recently, the Supreme Court (SC) has ruled in favor of the Delhi government on the issue of who controls the Bureaucratic control liesin the National Capital.
  • It ruled that the Delhi government has legislative and executive powers over services except for public order, police and land.
  • The Issues was referred by two-judge Bench of the SC in 2019, to be considered by a larger Bench.

Verdict of the SC :

  • “The principles of democracy and federalism are essential features of our Constitution and form a part of the basic structure,”

Article 239AA of the Constitution

  • Further, the Article 239AA also notes that L-G has to either act on the aid and advice of the Council of Ministers, or he is bound to implement the decision taken by the President on a reference being made by him.
  • Thus, this dual control between L-G and the elected government leads to a power tussle.
